Should I sue?

I was using a toothpick and got a splinter in my mouth. Grounds for a lawsuit?

I was going to ask what country you where in till I see your Florida title.... so yes If I was you I would sue.

no worse than the kid sueing because he misused a thermometer. wasn't his mouth...wasn't his nose...wasn't his ear... wasn't his butt.... but was definatly below the belt and he got it all the way in and it broke.

Well... seems that I wont have much of a case. I removed the splinter once it impaled itself in my cheek. (Instinctive reaction)

Wifey cleaned up this morning and now it's gone.

Break another toothpick into splinters, and claim that one of these new splinters was the culprit. Be sure to carefully wipe one end of it on the inside of your mouth so it has traces of saliva and skin cells on the end. You never know what kind of forensic experts the defence will have.

try shoving the toothpick in your knob hole and claim that the toothpick company never stated that it couldnt be used for self exploration.


Oh and dont forget to break it off. get way up in there with it too, you want surgery. It increases the claim.

There was a claim detailed in a recent American medical journal where a guy cut his leg off with a chainsaw (accidentally I assume) and then sued the chainsaw company for not printing a warning specifically cautioning against doing that.

Apparently you can now buy chainsaws in California which have 'do not use for human limb amputation', on the label; I am sure that will prevent more people doing it.

Overall therefore the toothpick thing stands a really good chance! Go go go! And can we have 10% of whatever you get for encouraging you?
